2009 is a year of important institutional
changes at European level, not least because the European Parliament
was reconstituted after the European elections on 4-7 June. Later in
the year, it will be the Commission’s turn to be renewed, and it can be
expected that it will also reorganise its departments, with the new
Parliament exercising an increasing degree of influence. July 2009 also
marks the start of the Swedish Presidency of the Council, which has
high on its agenda the objective of defining the action programme –
already called the ‘Stockholm Programme’ – for the next five years in
the area of freedom, security and justice.
The Council of Bars and Law Societies of
Europe (CCBE) which, through its members, represents over 700,000
lawyers from the European Union and European Economic Area and beyond,
is of course trying to influence the direction of the EU’s principal
policies in the field of justice. It is in this context that the CCBE
published a manifesto calling for ‘the right kind of justice for

Nu samlas EU:s ministrar för att diskutera Stockholmsprogrammet, ett avtal för förstärkt kontrollsamhälle och rasistisk flyktingpolitik.
Denna vecka samlas EU:s ministrar för rättsliga och inrikes frågor till ett informellt ministerrådsmöte i Stockholm. Det handlar om Stockholmsprogrammet, som ska ange ramarna när det gäller polis- och tullsamarbete, räddningstjänst, straffrättsligt och civilrättsligt samarbete, asyl, migration och viseringspolitik för åren 2010-2014. Programmet kommer att behandlas vid ministermötet i Stockholm för att slutligen antas av EU:s stats- och regeringschefer vid toppmötet i december i Bryssel. Die EU plant in den nächsten Monaten unter schwedischen Vorsitz einen
neuen fünf-Jahresplan zur "Harmonisierung" der Migrations- und
Asylpolitik zu verabschieden. Von 15. bis 17. Juli 2009 reisen die
Justiz- und Innenminister_innen zu einem informellen Treffen nach
Stockholm – und werden mit Widerstand konfrontiert.
In einem Aufruf zum Summer of Resistance 2009
ist zu lesen: Die Maßnahmen, die in Stockholm beschlossen werden
sollen, sind erst in einigen Jahren mit ihrer Ratifizierung in den
Mitgliedsstaaten spürbar. Es stehen tiefgreifende Veränderungen auf dem
Spiel: Ausbau und Vereinheitlichung von Polizei-Datenbanken, ein
zentrales Bevölkerungsregister, “grenzüberschreitende
Onlinedurchsuchung”, mehr Kontrolle des Internet, bessere
Satellitenüberwachung, “Risikoanalyse” mittels Software, “e-borders”
und “e-justice”, gemeinsame Abschiebeflugzeuge und – flüge, neue
Flüchtlingslager in “Drittstaaten”, Einsatz des Militärs zur
Migrationsabwehr, mehr polizeiliche Interventionen außerhalb der EU,
Ausbau der paramilitärischen “Europäischen Gendarmerietruppe”, mehr
Zusammenarbeit der In- und Auslandsgeheimdienste etc. Angestrebt wird
eine Art innenpolitische NATO mit der Schaffung einer
“euro-atlantischen Kooperation im Bereich Freiheit, Sicherheit und

The European Union’s wide-ranging Stockholm Programme risks further damaging citizens‘ hard earned privacy rights, argues Pirate Party member and long-time libertarian blogger Henrik Alexandersson.
EU ministers are gathering in Stockholm this week to advance their work on the Stockholm Programme, a five-year plan they claim is designed to make it easier to catch criminals and keep Europe’s citizens safe.
But despite soothing words from politicians about the programme’s virtues, it’s critical for EU citizens to stand up now and protest against the threat it presents to privacy and individual rights.
On the surface, the Stockholm Programme’s professed set of goals may appear somewhat benign – perhaps even sensible –with its calls for increased cooperation to fight terrorism and organized cross-border crime.
But we’ve already got a pretty good idea that the kinds of measures under consideration for meeting the Stockholm Programme’s goals are anything but benign.

Sweden
will take over the Presidency of the European Union (EU) at a pivotal
time in the development of European refugee law and policy. We are now
ten years on from the Council Meeting in Tampere in 1999, where Heads
of State and Government set themselves the objective of developing a
Common European Asylum System (CEAS) by 2010. With a new 5-year
programme due to be introduced during the Swedish Presidency, the
Stockholm Programme provides the EU with the opportunity to build a
fair and efficient common asylum system, which could serve as a model

The European Data Protection Supervisor (EDPS) has adopted an
opinion on the European Commission’s Communication of 10 June 2009
entitled “An area of freedom, security and justice serving the
citizen”. The Communication is the Commission’s contribution to the
discussions on the new EU programme for the next five years in the area
of justice and home affairs, the so called Stockholm programme, which
is due to be adopted by the European Council in December 2009.
The EDPS supports the attention that has been devoted in the
Communication to the protection of fundamental rights, and in
particular the protection of personal data, as one of the key issues of
the future framework for EU action on the questions of citizenship,
justice, security, asylum and immigration. He fully endorses the
Commission’s view that more emphasis should be given to data protection
in the areas concerned, and calls for the European Council to follow

Europäische Datenschutzbeauftragte (EDPS) Peter Hustinx hat eine
Stellungnahme zum Stockholmer Programm der EU veröffentlicht, wie ORF
Futurezone berichtet.
Das Stockholmer Programm legt die wichtigsten Entwicklungslinien der
EU-Innen- und Justizpolitik für die nächsten fünf Jahre fest. Hustinx
Fazit ist ernüchternd: "Die Gesellschaft bewegt sich in Richtung
Überwachungsgesellschaft, in der jede Transaktion und fast jede
Bewegung der Bürger aufgezeichnet werden." Zunehmen werde besonders die
Verwendung von RFID-Tags und Biometrie. "Dies führt dazu, dass eine
vernetzte Umgebung entsteht, in der Sicherheitsorgane Zugriff auf
potenziell nützliche Informationen erhalten, welche das Leben der
betroffenen Menschen direkt betreffen können", so Hustinx weiter.
Besonders bedenklich sei das Anzapfen von Datenbeständen in der
Privatwirtschaft, die ursprünglich gar nicht zu Fahndungszwecken

A new five year programme on legal cooperation within the EU will be high on the agenda during the Swedish EU presidency. The programme covers a wide span of collaborations including how to deal with inter-European criminals and with asylum seekers.
The current Hague Programme started in autumn 2004 and will run out by the end of the year. It will be replaced with the Stockholm Programme.

Der neue Fünfjahresplan europäischer Innenpolitik mutiert zur "Strategie der inneren Sicherheit" für die EU
In zwei Wochen wollen die Innenminister der EU ihren Entwurf für das "Stockholm Programm" vorlegen ("Quantensprünge" europäischer Sicherheitszusammenarbeit, Kritik am "Stockholm Programm").
Anfang Dezember will der Ministerrat der EU das Dokument endgültig
verabschieden. Aufbauend auf dem "Prinzip der Verfügbarkeit" (zum
Beispiel von Datenbanken oder regionaler Zusammenarbeit), das seit 2004
die europäische Innenpolitik bestimmt, wird die grenzüberschreitende
Kooperation von Strafverfolgungsbehörden weiter vertieft. Mit
Institutionen wie Europol und Frontex schafft sich die EU
supranationale innenpolitische Kompetenzen und entwickelt ein eigenes
(grenz-)polizeiliches Profil.
Die EU-Kommission hatte Anfang Juni eine ausführliche Auswertung des ablaufenden "Haager Programms" vorgelegt und Vorschläge
für das "Stockholm Programm" präzisiert. Bis dahin vermittelte
lediglich die letztes Jahr veröffentlichte, vage gehaltene Wunschliste
der EU-Innenminister (Die Wünsche der EU-Innenminister) eine Ahnung von den geplanten einschneidenden Veränderungen.
Jacques Barrot, EU-Kommissar für Justiz und Sicherheit, will mit dem "Stockholm Programm" eine "domestic security strategy for the EU" entwickeln:
